Health Quest Terms of Use

Welcome to HealthQuest. These Terms govern your use of the HealthQuest platform, website and related services, operated by TrueWellnessATX LLC d/b/a Equilibria Insights.
By creating an account or using HealthQuest, you agree to these Terms and to our Privacy Policy.
1. Who may use HealthQuest
Adults. You must be 18 or older to create an account as a parent or guardian.
Ages 13 to 17. A person aged 13 to 17 may create an account for their own use. That account is for that person only and cannot be used to add or manage other family members.
Under 13. A child under 13 may not create an account. A parent or legal guardian may create a profile for a child inside the guardian’s own account.
We rely on the date of birth you enter to decide which experience and which protections apply. Please enter it accurately.
2. What HealthQuest is — and what it is not
HealthQuest is a health-literacy and wellness-education platform for families. It provides quests and lessons, a wellness barrier assessment, guidance written for parents, and a game environment for children.
HealthQuest is not a medical service, a diagnostic tool, or a treatment.
You acknowledge and agree that:
Content is educational only and does not replace professional medical advice, diagnosis or treatment.
Always consult a licensed healthcare provider about any health concern, and before acting on anything you read here.
Never disregard or delay professional medical advice because of something you read in HealthQuest.
Every activity, quest and suggestion is voluntary and undertaken at your own discretion.
HealthQuest does not diagnose, treat, cure or prevent any condition, and nothing here is individualised clinical guidance for your child.
In an emergency, call 911 or seek immediate medical attention. If you or your child is in crisis, call or text 988.
3. Your account
You are responsible for keeping your login details secure and for everything done under your account. Tell us promptly if you believe someone else has accessed it.
One account per person. Do not share, sell or transfer your credentials, and do not use an account that is not yours.
4. Children and parental responsibility
If you create a profile for a child, you confirm that you are that child’s parent or legal guardian, and you are responsible for supervising their use of HealthQuest.
How a child’s profile is created. You register your own account and verify your email address with a one-time code. You then create your child’s profile from within your own signed-in account. No information is ever collected from a child directly.
What we collect about a child. Their first name, their date of birth, a username you choose, and a password the system generates. Nothing else. No email address, no phone number, no last name, no photograph, no location.
A child cannot type free text anywhere in HealthQuest. The daily check-in is an emoji chosen from a fixed set, and assessment answers are chosen from options we wrote. A child cannot be contacted through HealthQuest by us or by anyone else.
Your child’s login. When you create the profile, we show you the username and password on screen and email a copy to your verified address. We store the password in a form we cannot read back, so we cannot retrieve it later — but you can reset it at any time from your dashboard, which generates a new one. How you store and share those details is your responsibility.
You may at any time see everything we hold about your child, correct it, delete their profile and everything in it, or withdraw your permission. Write to us and we will act within 30 days. Our Privacy Policy explains more.
5. Acceptable use
You agree not to:
use HealthQuest unlawfully, or in breach of these Terms
create a profile for a child you are not the parent or legal guardian of
share, sell or transfer credentials, or access an account that is not yours
attempt to gain unauthorised access to any part of the service, another user’s account, or our systems
copy, scrape, reverse-engineer or create derivative works from the service
upload or transmit anything unlawful, harassing or harmful — particularly given that children use this service
interfere with the operation of the service, or circumvent any limit on your account or plan
use automated means to access the service without our written permission
We may suspend or end access for conduct in this section.
6. Intellectual property
Ours. All content in HealthQuest — text, graphics, logos, video, animation, software and trademarks — belongs to HealthQuest or its licensors. Reproducing or using it without permission is prohibited.
Yours. You keep ownership of what you create in HealthQuest, including your assessment responses and the entries you record. We use it to provide the service to you and as described in our Privacy Policy, and for nothing else.
Feedback. If you send us suggestions or ideas about the service, we may use them freely and without obligation to you.
7. Third-party services
HealthQuest may link to other websites or work alongside other platforms. These are provided for convenience and are not an endorsement. We are not responsible for their content or practices. Read their terms and privacy policies yourself.
8. Your information
Our Privacy Policy explains what we collect, why, and what you can do about it. It forms part of these Terms.
We use administrative, technical and physical safeguards to protect your information. No system is completely secure, and you use the service at your own risk. If a breach affects your personal information, we will notify you as required by law.
9. Subscriptions, billing and cancellation
Plans. HealthQuest offers a free tier and paid subscriptions. What each plan includes, and how many family members it supports, is shown at the point of purchase.
Billing. Paid plans are billed in advance through our payment processor. By subscribing you authorise us to charge your payment method on a recurring basis at the interval shown at purchase. We never see or store your card number.
Automatic renewal. Subscriptions renew automatically at the end of each term at the then-current price, unless you cancel before the renewal date. We will notify you before a renewal where the law requires it.
Cancellation. You may cancel at any time from your account settings or by writing to us. Cancellation takes effect at the end of your current billing period, and you keep access until then.
Refunds. If something isn’t right, write to us within 7 days of a purchase and we will review your request individually. Subscriptions are otherwise not refundable for the remainder of a term. You may cancel at any time to stop future renewals.
Price changes. We will give you notice before any price change affecting your renewal, and you may cancel before it takes effect.
Free tier. Provided as-is; we may change what it includes.
10. Changes to the service
We may modify, suspend or discontinue any part of HealthQuest. Where a change materially reduces functionality included in a paid plan you hold, we will tell you, and you may cancel for a pro-rata refund of the unused portion of your term.
11. No warranty, and limits on our liability
HealthQuest is provided “as is” and “as available.” To the fullest extent permitted by law we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the service will be uninterrupted, timely, secure or error-free.
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits or data.
Our total liability for any claim will not exceed the greater of what you paid us in the twelve months before the claim, or one hundred US dollars.
Some jurisdictions do not allow these exclusions, so parts of this section may not apply to you. Nothing in these Terms limits any liability that cannot lawfully be limited.
12. Ending access
By us. We may suspend or end access for anyone who breaks these Terms or misuses the platform, and we may discontinue the service or any part of it.
By you. You may close your account at any time by writing to us. We will delete or de-identify your information as described in our Privacy Policy, except where the law requires us to keep it.
After termination, your right to use HealthQuest ends. Sections that should survive by their nature — including sections 6, 11, 13 and 14 — survive.
13. Indemnity
You agree to indemnify and hold harmless HealthQuest from claims arising out of your use of the service, your breach of these Terms, or your violation of any third party’s rights.
14. Disputes
Let’s try to sort it out first. If you have a problem, write to us at April@discoverhealthquest.com. Most things can be resolved this way, and we would rather hear from you.
Small claims. Either of us may bring a claim in small claims court instead of arbitration, if it qualifies.
Arbitration. Otherwise, disputes about HealthQuest will be resolved by binding arbitration in Travis County, Texas, under the rules of the American Arbitration Association.
You can opt out. If you do not want to be bound by the arbitration provision, write to April@discoverhealthquest.com within 30 days of first accepting these Terms and say so. Opting out will not affect your use of HealthQuest in any way.
Governing law. These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules.
15. Accessibility
We want HealthQuest to work for everyone, including people with disabilities. If you hit a barrier, tell us at April@discoverhealthquest.com and we will work with you.
16. Language and translation
HealthQuest is offered in English and Spanish. The English version is the official version of this service and of these Terms.
Spanish is produced by machine translation together with manually maintained translations and has not been reviewed by a professional translator. It may contain errors or wording that differs in meaning from the English, and some parts of the service may appear in English whichever language you choose.
Where the Spanish and English differ, the English governs.
HealthQuest provides general health education, not medical advice. If anything in Spanish is unclear, or looks different from the English, rely on the English and speak with your child’s healthcare provider.
17. Changes to these Terms
We may update these Terms. The date at the top will change, and we will tell you about material changes in the platform or by email. Continuing to use HealthQuest after a change means you accept it.
18. General
Entire agreement. These Terms and the Privacy Policy are the whole agreement between you and HealthQuest about the service.
Severability. If any provision is unenforceable, the rest stays in effect.
No waiver. Not enforcing a provision is not a waiver of it.
Assignment. You may not assign these Terms. We may, in connection with a merger, acquisition or sale.
Force majeure. We are not liable for failure to perform due to causes beyond our reasonable control.
